Economic operator

An economic operator in EU public procurement is any natural or legal person, public body, or group of such persons or entities—including temporary associations—offering to execute works, supply goods, or provide services on the market. This term is used broadly in EU directives to encompass contractors, suppliers, service providers, vendors, and other market actors who can participate in procurement processes.

The concept ensures inclusivity, allowing various organizational structures to participate in tenders. EU law explicitly permits economic operators to rely on capacities of third parties—like subcontractors or technical partners—to meet selection criteria. This flexibility supports smaller entities and encourages partnership and innovation, provided the arrangements are transparent and genuinely intended for contract performance—not to distort competition.

In practice, economic operators are the potential bidders in procurement. They submit EOIs or tenders, and if successful, may become contractors or awardees. The concept is central to procurement law because it defines who is eligible to compete, underpins selection and exclusion principles, and structures submission obligations.
