Framework Agreement (Framework Contract)

A framework agreement—also known as a framework contract—is an “umbrella” agreement between one or more contracting authorities (buyers) and one or more economic operators (suppliers). It sets out the general terms and conditions—such as pricing, quality standards, and quantities—for the procurement of goods, services, or works over a specified period. The framework itself is not a binding order, but it provides a structure from which specific contracts, known as call-off contracts, can be made as needs arise.

Under EU Directive 2014/24/EU, framework agreements are permitted, but must not exceed four years, unless exceptional and justifiable circumstances apply based on the subject matter of the agreement. In single-supplier frameworks, call-off contracts may be awarded directly according to the agreement’s terms. For multi-supplier frameworks, contracting authorities must conduct mini-competitions among framework members or use pre-agreed allocation methods (like ranking, rotation, or percentage share) to ensure fairness and transparency.

In practice, framework agreements deliver efficiency and flexibility. They avoid repeating full procurement procedures for every order, speeding up procurement timelines while maintaining compliance with procedural standards. However, every call-off must adhere to the terms set out in the framework agreement and cannot substantially deviate from its terms. Clear documentation—covering duration, maximum value, subject matter, award methods, and call-off procedures—is essential to uphold legal certainty and uphold principles like equal treatment and transparency.
