Contracting authority

A contracting authority is a public sector entity—such as a government ministry, regional authority, municipality, or other body governed by public law—that carries out procurement to acquire goods, services, or works. Within the framework of EU procurement directives, these authorities are the buyers that issue tenders, manage the procurement process, and ultimately sign contracts with successful bidders. They play a central role in public procurement, acting as the formal counterparty to suppliers.

In EU legal terms, contracting authorities encompass a wide range of public institutions, including associations formed by public bodies. The designation ensures that these entities must comply with EU procurement rules—such as transparency, equal treatment, and non-discrimination. In certain cases, specially established entities like central purchasing bodies are also recognized as contracting authorities when they procure on behalf of other public entities.
