Works

Works refer to construction-related procurement contracts encompassing activities such as the execution, design, or completion of engineering and building projects. Common examples include the construction of roads, hospitals, schools, infrastructure works, or civil engineering structures. Works contracts may involve design-and-build responsibilities and are distinct from supply (goods) and service contracts. These contracts frequently require specialized procedures (e.g., performance bonds, safety standards) due to their scale, complexity, and typically high value.

Under EU law, works contracts are categorized separately and often have higher procurement thresholds compared to goods or services. For instance, as of 1 January 2024, the threshold for above-EU-procurement-value works contracts is approximately €5,538,000, triggering obligations such as publication in the Official Journal and use of formal procedures. The definition in the EU context also includes the deliverable outcome of building or civil engineering works that fulfil a technical or economic function.

In practice, works contracts involve rigorous planning, risk management, and regulatory compliance. Because of their scale, they are frequently awarded through open or restricted procedures and demand safeguards such as performance bonds, safety oversight, and staged delivery. For contractors, submitting a compliant bid for a works contract often requires detailed technical proposals—while for authorities, robust contract management is vital to ensure delivery, quality, and value for money.
